Legal
Terms of Use
Last updated: April 2025 · BIT Zambia / Zedlayby
1. About these terms
These terms apply to everyone who uses Zedlayby — whether you're browsing as a shopper, applying for a layby, or listing products as a retailer. By creating an account or using the platform, you agree to these terms.
Zedlayby is operated by BIT Zambia. If you have questions, contact us at info@zedlayby.com.
2. What Zedlayby does
Zedlayby is a discovery and management platform. We connect shoppers with retailers who offer layby plans. We check that plans meet the legal requirements of Zambia's Hire-Purchase Act (Cap 399). We help generate written agreements.
We are not a party to any layby agreement. The agreement is always between you (the shopper) and the retailer. We do not lend money, hold payments, or guarantee the goods or services being sold.
3. Your account
You must be at least 18 years old to create an account. You are responsible for keeping your login details secure and for everything that happens on your account. Please notify us immediately if you believe your account has been accessed without your permission.
You must provide accurate information when you register. Providing false information — including about a business's registration status — may result in your account being suspended.
4. For shoppers
When you apply for a layby, you are making a request to the retailer. The retailer decides whether to approve your application. Once approved, both you and the retailer are bound by the terms of the written agreement generated on the platform.
Your rights under the Hire-Purchase Act (Cap 399) apply to every agreement made through Zedlayby — including your right to a written agreement, your right to pay off early, and your right to terminate under certain conditions. You can learn more on our Shopper Rights page.
5. For retailers
By listing on Zedlayby, you confirm that your business is legally registered in Zambia and that all information you provide is accurate. You are responsible for the products and services you list, for honouring approved applications, and for complying with the Hire-Purchase Act.
Zedlayby validates your plans against the legal requirements before they go live. However, this validation does not replace your own legal responsibility to comply with the law.
We reserve the right to remove any listing that is misleading, in breach of the law, or that generates repeated complaints from shoppers.
6. Prohibited conduct
You must not use Zedlayby to:
- Submit false applications or list products you do not sell
- Harass, deceive or defraud other users
- Attempt to access parts of the platform you are not authorised to use
- Post content that is illegal, offensive or misleading
Accounts found in breach of these rules will be suspended. Serious cases may be referred to the relevant authorities.
7. Disputes between shoppers and retailers
Zedlayby is not a mediator or arbitrator. If a dispute arises between a shopper and a retailer, we encourage both parties to resolve it directly. You may also contact the Zambia Competition and Consumer Protection Commission (ZCCPC) for guidance on your rights.
We may, at our discretion, suspend an account while a serious complaint is being investigated.
8. Limitation of liability
We do our best to keep the platform reliable and accurate. However, we cannot guarantee that it will always be available or error-free. To the extent permitted by Zambian law, BIT Zambia is not liable for any losses arising from your use of the platform or from a dispute with another user.
9. Changes to these terms
We may update these terms from time to time. Continued use of the platform after an update means you accept the new terms. We'll notify you of significant changes via the platform.
10. Governing law
These terms are governed by the laws of the Republic of Zambia. Any disputes arising from the use of Zedlayby are subject to the jurisdiction of the courts of Zambia.
